At Digital Human Library (dHL), we believe that meaningful access to technology empowers students and educators to learn, connect, communicate, and collaborate in engaging new ways. These experiences help students build the digital literacy, communication, and critical thinking skills they need for success in school, work, and everyday life.<\/p>\n

The Terms of Use below are intended to support a safe, respectful, and positive experience when using dHL services. They also help guide students in becoming responsible and contributing digital citizens.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

Terms of Use Agreement<\/h2><\/div><\/div>\n\n

Digital Human Library (\u201cdHL\u201d) offers members access to a community of industry professionals, a database of web-based virtual tours and virtual reality experiences, digital experiential learning opportunities, programs and resources, and provides online registration services to facilitate the enrolment and registration of yourself (collectively, \u201cyou\u201d, \u201cyour\u201d, or applicable derivation thereof) within the program(s) and\/or service(s) you have selected (the \u201cServices\u201d) through this Website (the \u201cSite\u201d).<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

1. Acceptance of Agreement<\/h2><\/div><\/div>\n\n

By accessing this Site, you agree to the terms and conditions outlined in this Terms of Use Agreement (\u201cAgreement\u201d) with respect to the Site. This Agreement constitutes the entire and only agreement between Digital Human Library and you for use of the Site, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, including the Content (as defined below).<\/p>\n

You agree to review this Agreement prior to using or gaining further access to the Site. Digital Human Library may amend this Agreement from time to time without specific advance notice to you. The most updated version will be posted on the Site, and you should review this Agreement prior to using the Site at any time.<\/p>\n

Digital Human Library may immediately terminate the use of the Site by any user if that user has used the Site in any way contrary to this Agreement, any applicable law, or in any way that disrupts the Site. If you are dissatisfied with the terms, conditions, rules, policies, guidelines, or practices of the Site, your sole and exclusive remedy is to discontinue using the Site.<\/p>\n<\/div><\/div>\n\n

1A. Privacy Law Compliance<\/span><\/h4>\n<\/div><\/div>\n\n

dHL does not collect or store student Personal Information. Students are not permitted to create accounts on the Site, and no student data passes through or is retained by dHL at any time.<\/p>\n

Educators and institutions accessing the Site in an educational setting remain solely responsible for their own compliance with applicable student privacy laws in their jurisdiction. These include, but are not limited to:<\/p>\n<\/div><\/div>\n\n

    Applicable US state privacy laws, including the California Consumer Privacy Act (CCPA) where applicable.<\/div><\/li>\n<\/ul>\n\n

    1B. Eligibility and Authorized Use<\/span><\/h4>\n<\/div><\/div>\n\n

    Access to the Site and Services is limited to certified educators, verified industry professionals, and other individuals approved by Digital Human Library. Students are not permitted to create accounts on the Site. All student participation must occur under the direct supervision and authority of a teacher or authorized educational institution. For the purposes of this Agreement, \u201cdirect supervision\u201d includes oversight of asynchronous and virtual activities conducted through or facilitated by the Site.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    2. Copyright<\/h2><\/div><\/div>\n\n

    All materials displayed or otherwise accessible through the Site \u2014 including without limitation text, logos, graphics, photographs, images, and illustrations (collectively, the \u201cContent\u201d) \u2014 are protected under applicable Canadian and foreign copyright, trademark, and other proprietary and intellectual property laws. You acknowledge that the Content is the property of Digital Human Library, its suppliers, partners, and\/or licensors or other applicable owners as the case may be. The Site is also protected under copyright law as a collective work and\/or compilation pursuant to Canadian and foreign laws.<\/p>\n

    The copying, redistribution, use, or publication by you of any such Content or any part of the Site, except as allowed by Section 3, is strictly prohibited. You do not acquire ownership rights to any Content obtained through the Site. You shall abide by all additional copyright notices, information, and restrictions contained in any Content accessed through the Site.<\/p>\n

    You may not reproduce, in whole or in part, any information, opinion, or conclusion contained in any materials posted on the Site without the prior written consent of Digital Human Library.<\/p>\n

    Third-party sites accessed by hyperlink have been independently developed by parties other than Digital Human Library. Digital Human Library does not endorse or warrant the accuracy of information contained on such sites.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    3. Plagiarism<\/h2><\/div><\/div>\n\n

    Members must not plagiarize \u2014 that is, use as their own, without citing the original creator \u2014 any content, including words or images, from the Internet or any other source.<\/p>\n

    Members must not take credit for things they did not create themselves, or misrepresent themselves as the author or creator of something found online. Research conducted via the Internet must be appropriately cited, giving credit to the original author.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    4. Limited Right to Use<\/h2><\/div><\/div>\n\n

    Subject to the terms and conditions of this Agreement, you are granted the right to: (i) input your applicable information within and through the Site; (ii) access, view, and use the Site for your personal, non-commercial use; and (iii) download, store, and print single copies of items comprising the Content for your personal, non-commercial use, provided that you maintain all copyright and other notices contained in such Content.<\/p>\n

    The information contained on the Site is for informational purposes only. Digital Human Library makes no warranty, express or implied, as to the accuracy, completeness, currency, or reliability of any Content posted on the Site, and expressly disclaims any liability for out-of-date or inaccurate information. The Services are intended solely for non-commercial educational use, and any use outside of this purpose is strictly prohibited unless expressly authorized in writing by Digital Human Library.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    5. Editing, Deleting, and Modification<\/h2><\/div><\/div>\n\n

    You agree to release, indemnify, defend, and hold Digital Human Library and its directors, officers, employees, agents, and representatives harmless from any liability, loss, claim, and expense \u2014 including reasonable legal fees \u2014 related to your violation of this Agreement, improper use of the Site, or your failure to comply with applicable laws, school board policies, or student privacy obligations.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    7. Disclaimer<\/h2><\/div><\/div>\n\n

    Digital Human Library provides the Site on an \u201cas is\u201d and \u201cas available\u201d basis, for your convenience. Digital Human Library makes no express or implied warranties, representations, or endorsements with respect to the Site or its contents, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, usefulness, completeness, accuracy, or reliability.<\/p>\n

    Digital Human Library does not represent or warrant that the Site will be available or meet your requirements, that access will be uninterrupted, or that there will be no delays, failures, errors, omissions, or loss of transmitted information. Digital Human Library does not warrant that the Site is free of viruses or other contaminating or destructive properties. You have sole responsibility for adequate protection and backup of your data, hardware, and software, and for taking reasonable precautions against such risks.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    8. Collection, Use, and Disclosure of Personal Information<\/h2><\/div><\/div>\n\n

    The collection, use, and disclosure of Personal Information provided to Digital Human Library through this Site is governed by our Privacy Policy, available on the Site.<\/p>\n

    dHL does not collect or store student Personal Information. The only Personal Information dHL requires from member educators is an email address and country of residence. Additional information may be provided voluntarily as described in the Privacy Policy.<\/p>\n

    Digital Human Library acts as a service provider to educational institutions pursuant to applicable data processing arrangements and does not assume the role of a \u201cschool authority\u201d with respect to student records. Responsibility for compliance with student data protection laws \u2014 including FERPA, COPPA, PIPEDA and its successor legislation, applicable provincial privacy legislation, and where applicable US state privacy laws including the CCPA \u2014 remains entirely with the educational institution and its authorized representatives.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    9. No Harmful Use<\/h2><\/div><\/div>\n\n

    You agree not to introduce into or through the Site any information or material that may be harmful to others. You warrant that any information or material you provide through the Site does not infringe the rights of any person or entity. Without limiting the foregoing, you must not:<\/p>\n

    (a)<\/strong>\u00a0<\/span>upload, post, transmit, publish, or distribute any material or information to the Site that contains a computer virus or other code, files, or programs intended to disrupt or interfere with the functioning of the Site;<\/p>\n

    (b)<\/strong>\u00a0<\/span>use the Site to gain unauthorized entry or access to the computer systems, networks, or information of others, or attempt to access any password-protected or restricted areas of the Site or Digital Human Library\u2019s computer or network systems;<\/p>\n

    (c)<\/strong>\u00a0<\/span>violate any law or regulation or any generally accepted Internet practice, or interfere with any other user\u2019s ability to use the Site or its services;<\/p>\n

    (d)<\/strong>\u00a0<\/span>forge, alter, or modify in any way any agreements, policies, or other information posted or accessible within the Site;<\/p>\n

    (e)<\/strong>\u00a0<\/span>transmit any message, information, data, text, software, images, or other content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, or otherwise objectionable, or that may invade another\u2019s right of privacy;<\/p>\n

    (f)<\/strong>\u00a0<\/span>delete or revise any material posted by any other person or entity;<\/p>\n

    (g)<\/strong>\u00a0<\/span>upload, transmit, or otherwise make available any personally identifiable information of a student without the prior written authorization of the relevant educational institution and, where required by applicable law, the written consent of a parent or legal guardian; or<\/p>\n

    (h)<\/strong>\u00a0<\/span>record, reproduce, distribute, share, or generate AI-assisted transcripts or summaries of any live or virtual session, in whole or in part, without the prior written consent of all participants.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    10. Safety<\/h2><\/div><\/div>\n\n

    The content partners, experts, and digital content available through dHL have been vetted and curated by a team of trained, certified Ontario teachers and teacher librarians for use with students. This vetting applies to dHL\u2019s content partners and experts; it does not extend to the underlying third-party platforms or tools through which such content may be delivered, which are governed by Section 16.<\/p>\n

    Members should be aware that people and digital content accessed outside of dHL are unverified and may be irrelevant or inappropriate for classroom use. Teachers remain responsible for supervising all student interactions and for determining the appropriateness of any engagement within their classroom context.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    11. Termination of Site Use<\/h2><\/div><\/div>\n\n

    Termination of Site use is at Digital Human Library\u2019s sole discretion. Digital Human Library may terminate or refuse to permit the use of the Site by any person, for any reason and without notice. Without limiting the foregoing, Digital Human Library may suspend or terminate access where required to ensure compliance with applicable laws, student safety, or privacy obligations.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    12. Applicable Law and Dispute Resolution<\/h2><\/div><\/div>\n\n

    This Site originates in Canada. This Agreement will be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.<\/p>\n

    In the event of a dispute arising out of or in connection with this Agreement or the Site, the parties agree to first attempt to resolve the matter informally by contacting Digital Human Library at the address set out in our Privacy Policy. If the dispute cannot be resolved informally within thirty (30) days, it shall be referred to non-binding mediation before either party may initiate formal legal proceedings. Any claims or legal proceedings that proceed beyond mediation shall be brought solely in the courts of the Province of Ontario. By accessing or using the Site, you expressly submit to the exclusive jurisdiction of those courts.<\/p>\n

    Users accessing the Site from outside Canada, including from the United States, acknowledge that they are responsible for compliance with local laws to the extent such laws are applicable.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    13. Survival<\/h2><\/div><\/div>\n\n

    The provisions of Sections 2, 3, 4, 5, 6, 7, 8, 9, and 12 of this Agreement shall survive the expiry or termination of this Agreement for any reason.<\/span><\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

    14. Cookies and Tracking Technologies<\/h2><\/div><\/div>\n\n

    This Site uses cookies and similar tracking technologies to identify users, compile website usage statistics, and provide customized services. Cookies are small text files stored on your device to identify your browser and preferences.<\/p>\n

    dHL uses the following third-party tools that may set cookies or collect usage data:<\/p>\n<\/div><\/div>\n\n

      Google Analytics - used to analyze Site traffic and usage patterns. Data collected by Google Analytics is processed in accordance with Google's privacy policies. You may opt out of Google Analytics tracking by using the Google Analytics Opt-out Browser Add-on.<\/div><\/li>\n\n

      HubSpot \u2014 used to manage member communications and marketing activity. Data collected by HubSpot is processed in accordance with HubSpot\u2019s privacy policies.<\/div><\/li>\n<\/ul>\n\n

      Our use of cookies does not enable third parties to access your Personal Information beyond what is described above. You may configure your browser to refuse cookies, although this may affect the functionality of certain features of the Site.       15. Premium Membership and Payments<\/h2><\/div><\/div>\n\n

      dHL offers a premium membership tier that provides access to additional features and Services. By subscribing to a premium membership, you agree to the following:<\/p>\n

      Billing and Subscription<\/strong>
      Premium membership fees are billed on the subscription cycle selected at the time of purchase (monthly or annual, as applicable). All fees are stated in Canadian dollars unless otherwise indicated at the time of purchase. Fees are subject to change with reasonable advance notice posted on the Site.<\/p>\n

      Payment Processing<\/strong>
      All payments are processed through a secure third-party payment gateway. dHL does not collect, store, or have access to your full payment card details. Payment information is handled in accordance with applicable Payment Card Industry Data Security Standards (PCI-DSS). Your use of the payment gateway is subject to that provider\u2019s terms and privacy policy.<\/p>\n

      Cancellation and Refunds<\/strong>
      You may cancel your premium membership at any time. Cancellation will take effect at the end of the current billing period. dHL does not provide refunds for partial subscription periods unless required by applicable law.<\/p>\n

      Termination of Premium Access<\/strong>
      Digital Human Library reserves the right to suspend or terminate premium membership access in the event of a violation of this Agreement, non-payment, or as otherwise permitted under this Agreement.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      16. Intellectual Property of Member Contributions<\/h2><\/div><\/div>\n\n

      By submitting, posting, or otherwise making available any content, profile information, resources, or materials through the Site (collectively, \u201cMember Content\u201d), you retain ownership of that content. However, you grant Digital Human Library a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your Member Content solely for the purpose of operating and improving the Site and its Services. This licence terminates when your Member Content is removed from the Site or your account is closed.<\/p>\n

      You represent and warrant that you have the right to submit any Member Content you provide, and that doing so does not infringe the intellectual property or other rights of any third party.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      17. Third-Party Services<\/h2><\/div><\/div>\n\n

      The Site may integrate with or provide access to third-party tools, platforms, or services, including Google Analytics and HubSpot as described in Section 14. Digital Human Library does not control and is not responsible for the content, policies, or practices of such third parties. Your use of third-party services is at your own risk and is subject to their respective terms and policies.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      18. Data Breach Notification<\/h2><\/div><\/div>\n\n

      In the event of a breach of security involving your Personal Information that creates a real risk of significant harm, Digital Human Library will notify you and, where required, the relevant privacy regulatory authority, in accordance with applicable law including PIPEDA and applicable US state breach notification laws. Notification will be provided as promptly as circumstances permit.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      19. Accessibility<\/h2><\/div><\/div>\n\n

      Digital Human Library is committed to making the Site accessible to all users, including those with disabilities.       20. Policies and Procedures<\/h2><\/div><\/div>\n\n

      All general policies and procedures published by Digital Human Library are subject to and governed by this Agreement. In the event of any conflict between a policy or procedure and this Agreement, this Agreement shall take precedence.       21. General<\/h2><\/div><\/div>\n\n

      This is the entire agreement between Digital Human Library and you regarding your use of the Site, except for any agreements between you and Digital Human Library that expressly reference this Agreement. Digital Human Library\u2019s failure to insist upon or enforce any provision of this Agreement shall not be considered a waiver of that provision or of the right to enforce it. If any part of this Agreement is determined to be void, invalid, or unenforceable, the remaining parts will not be affected and will remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      Responsible Use Guidelines<\/h2><\/div><\/div>\n\n

      Digital Human Library encourages teachers, staff, and other authorized school community members to connect with industry professionals, share educational resources, and engage with virtual and digital experiential learning content in ways that enhance the classroom experience. While these opportunities are valuable, there are important responsibilities to keep in mind.<\/p>\n

      These guidelines apply to all authorized users of the Site and are intended to support a safe, respectful, and professional community for educators, industry professionals, and the students they serve.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      1. Use Good Judgment<\/h2><\/div><\/div>\n\n

      Use good judgment in all situations. Before posting, sharing, or engaging with any content or individual through the Site, ask yourself whether your actions would reflect well on you, your school, and your profession.<\/p>\n

      You must know and follow your school board or district\u2019s Code of Conduct and Privacy Policy at all times. Where your board\u2019s or district\u2019s policies are more restrictive than these guidelines, those policies take precedence.<\/p>\n

      Regardless of your privacy settings, assume that all information you share through the Site or associated networks may be treated as public information. Do not share anything you would not be comfortable seeing in a public forum.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      2. Be Respectful and Professional<\/h2><\/div><\/div>\n\n

      Always treat others in a respectful, positive, and considerate manner \u2014 including content partners, industry professionals, fellow educators, and dHL staff.<\/p>\n

      Harassment, discrimination, personal attacks, and disrespectful language of any kind are not acceptable on the Site or in any dHL-facilitated session. This applies equally to written communications, live sessions, and recorded interactions.<\/p>\n

      Members who engage in disrespectful or unprofessional conduct may have their access suspended or terminated without notice.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      3. Be Responsible and Ethical<\/h2><\/div><\/div>\n\n

      Be transparent about your affiliation with your school or district and the role you hold. Unless you are specifically authorized to speak on behalf of your school or district, make clear that the views expressed in your online interactions are your own and do not represent those of your institution.<\/p>\n

      Confine your discussions and activities on the Site to educational matters within your area of responsibility. Do not use the Site or dHL\u2019s community for personal promotion, commercial solicitation, or any purpose unrelated to professional learning and educational collaboration.<\/p>\n

      Represent yourself and your credentials honestly. Misrepresentation of your professional status, qualifications, or institutional affiliation may result in immediate removal from the platform.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

      4. Protect Student Privacy<\/h2><\/div><\/div>\n\n

      The privacy and safety of students is a shared responsibility. When using the Site in connection with your classroom or students, you must:<\/p>\n<\/div><\/div>\n\n

        Never share, post, or transmit any personally identifiable information about a student through the Site, including names, photographs, school identifiers, or any other information that could identify a student;<\/div><\/li>\n\n

        Ensure that all student participation in dHL-facilitated activities occurs under your direct supervision;<\/div><\/li>\n\n
      • \uf1ce<\/span>
        Obtain and retain any required parental or guardian consents before involving students in virtual sessions or experiential learning activities; and<\/div><\/li>\n\n
      • \uf1ce<\/span>
        Comply with all applicable student privacy laws in your jurisdiction, including FERPA, COPPA, PIPEDA, and applicable provincial legislation.<\/div><\/li>\n<\/ul>\n\n

        If you become aware of a potential privacy breach involving student information, notify your school administration and, where required, the relevant privacy authority immediately.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

        5. Be a Good Listener and Collaborator<\/h2><\/div><\/div>\n\n

        One of the key benefits of the dHL community is the ability to connect directly with industry professionals and fellow educators from across Canada and the United States. Make the most of these connections by approaching every interaction as an opportunity for genuine professional learning.<\/p>\n

        6. Protect Confidential and Personal Information<\/h2><\/div><\/div>\n\n

        Do not publish, post, or share information that is confidential, sensitive, or not intended for public distribution. If information feels like it should be confidential, treat it as such.<\/p>\n

          7. Use and Share Content Responsibly<\/h2><\/div><\/div>\n\n

            8. Use Premium Features Responsibly<\/h2><\/div><\/div>\n\n

            Members with premium membership access are entrusted with additional features and capabilities within the dHL community. Premium features must be used in accordance with this Agreement and these guidelines.             9. Respect Recording and Session Policies<\/h2><\/div><\/div>\n\n

            Do not record, photograph, screenshot, or otherwise capture any live or virtual session facilitated through dHL without the prior written consent of all participants. This includes generating AI-assisted transcripts or summaries of sessions without consent.<\/p>\n

            Content shared during sessions \u2014 including presentations, materials, and personal disclosures \u2014 is shared in a professional context and must be treated with discretion. Do not redistribute session content without the permission of the presenter or content partner.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

            10. Report Concerns<\/h2><\/div><\/div>\n\n

            If you witness or experience conduct that violates these guidelines \u2014 including disrespectful behaviour, privacy breaches, inappropriate content, or suspicious activity \u2014 report it to dHL promptly by contacting us at the address provided in our Privacy Policy.<\/p>\n

            dHL takes all reports seriously and will investigate concerns in a timely and confidential manner. Members who report concerns in good faith will not face retaliation.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n<\/div>\n\n

              These Responsible Use Guidelines form part of the dHL Terms of Use Agreement. By accessing or using the Site, you agree to be bound by both this Agreement and these guidelines.
